These Terms & Conditions (“Terms”) govern your use of this website (the “Site”), run by the band XYRO (“XYRO”, “we”, “us”), based in Toronto, Ontario, Canada. By using the Site you agree to these Terms. If you don’t agree, please don’t use the Site.
1. Using the Site
You may browse, stream, share links and enjoy the Site for personal, non-commercial use. You agree not to:
- flood, spam or overload the Site, its forms or its mailing list, including repeated or automated submissions;
- use bots, scrapers, crawlers or scripts to access, copy or submit anything, other than normal search-engine indexing;
- probe, scan or test the Site’s security, or bypass rate limits, verification checks or other protections;
- upload or send malware, or anything unlawful, hateful, harassing, sexually explicit, violent or infringing;
- impersonate anyone, or submit someone else’s personal information without their permission;
- interfere with other visitors or with the Site’s operation in any way.
We may block access, reject submissions, or remove content at any time to protect the Site, the band or its fans.
2. Our content
All music, recordings, video, photos, artwork, text, the XYRO name, logo, pentacle mark and site design are owned by XYRO or its licensors and protected by copyright and trademark law. Nothing here gives you a licence to reuse them beyond personal viewing and sharing links to the Site. For licensing or sync, contact our publishing desk.
3. Your submissions
Photos and messages you send are covered by our Submission Terms, which form part of these Terms.
4. Mailing list
Joining is optional and needs your express consent. You can unsubscribe at any time using the link in any email. See our Privacy Policy.
5. Third-party services
Pre-saves, streaming, videos, social links and the merch store are run by third parties (for example Spotify, Apple Music, YouTube, Instagram, Facebook and our store provider) under their own terms and privacy policies. We aren’t responsible for their services. Purchases made through the store are governed by the store’s terms of sale.
6. No warranty
The Site is provided “as is” and “as available”. Dates, releases and availability may change. We don’t promise that the Site will be uninterrupted or error-free.
7. Limitation of liability
To the fullest extent permitted by law, XYRO and its members are not liable for any indirect, incidental or consequential loss arising from your use of the Site. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded, including Ontario’s Consumer Protection Act.
8. Indemnity
If you breach these Terms or submit content you had no right to submit, you agree to cover the reasonable costs and claims that result.
9. Changes
We may update these Terms. The date at the top shows the latest version, and continuing to use the Site means you accept the update.
10. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes go to the courts of Ontario, sitting in Toronto.
